Terms & Conditions
 
These terms and conditions are the terms and conditions under which Thames Valley Energy Services Limited (TVES) makes services available to you.
 
1  Our Agreement
 
1.1  The prices payable for the service that you order will be agreed at the point of order and    confirmed by email.
 
1,2  We will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.
 
2  Deliver and Performance
 
2.1  Attendance  In due course, we will send one of our personnal to the address to carry out the service. Attendance of our personnel will be made by appointment within a reasonable period of time. Some EPC types do not require a visit.
 
2.2  Delivery of Reports  HIPs and EPCs will be delivered in electronic pdf. format. Printed copies can be made available for an additional fee as follows:
 
2.2.1  HIPs    £10   + VAT (postage and package included)
 
2.2.2  EPCs  £3.50 + VAT (postage and package included)
 
3  Cancellation by You
 
To cancel a contract, you must inform us in writing by email or post. Payment made in respect of the order is non - refundable if you cancel after the work has been carried out.
 
4  Cancellation by Us
 
4.1  We reserve the right to cancel the contract between us if:
 
4.1.1  we have insufficient personnel to carry out your order;
4.1.2  your order was listed at an incorrect price due to a typographical error.
 
4.2  If we do cancel the contract we will notify you by email and we will either offer an alternative or re- credit to your account any sum deducted by us from your credit card as soon as possible. We will not be obliged to offer any additional compensation for disappointment suffered or for any other reason.
 
5  Payment for Services
 
5.1  Non-Account Customers  We must receive payment in full for the price of the service before your report can be delivered.
 
5.2  Account Customers  We will invoice monthly for 30 days payment.
 
5.3  Method of Payment  Payment will be accepted by bank transfer, credit or debit card or cheque.
 
6  Liability
 
6.1  The Energy Performance Certificate (the 'certificate') which you obtain as a result of the visit from our personnel is marked on a standard scale and we are in no way liable for the grade awarded to your property in the certificate.
 
6.2  Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation.
 
6.3  Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer or business under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
 
6.4  We will do our utmost to ensure that availability of the website will be uninterrupted, however, this can not be guaranteed at all times. TVES accepts no responsibility for any such suspensions, restrictions,interruptions or delays. We reserve the right to make changes to our website, policies and these terms and conditions at any time.
 
7  Notices
 
7.1  A notice under or in connection with these terms and conditions shall be in writing and shall be delivered personally or sent by first class post or by fax or by email, as follows:

7.1.2  If to you, to:  the address supplied on the order by you.
 
8  Events Beyond Our Control
 
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breaksown of systems or network access, flood, fire, explosion or accident.
 
9  Invalidity
 
If any part of these terms and conditions is unenforceable ( including any provision in which we exclude our liability to you) the enforceability of any other part of these terms and conditions will not be affected.
 
10  Privacy
 
You acknowledge and agree to be bound by the terms of our privacy policy. Please go to the

11  Third Party Rights
 
Except for our affiliates, directors,employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions but this does not affect any right or remedy of a third party that exist or is available apart from the Act.
 
12  Entire Agreement
 
These terms and conditions, together with the website prices, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us and use of the website.
 
13  Governing Law
 
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
 
14 Definition
 
The 'EPC' is as defined in the EU Directive 2002/91/EC on the Energy Performance of Buildings. 
 
15 Discrimination Policy

We adopt the same principles, where they apply, to our dealings with customers and suppliers.
